Appointment of Guardians - Crittenden County 1882

A guardian was appointed when a person was unable to act for himself or was a minor (under the age of 21 years). The parents may or may not have been living. At the age of 14, a minor could choose his own guardian. If under the age of 14, the county court appointed the guardian. The guardian was required to execute a bond with a surety also signing. If the parents were deceased or unable to provide for the minor children, instead of the appointment of a guardian, the children were likely apprenticed to someone in the community to learn a trade.  The guardian appointments listed below can be found in Crittenden County, Kentucky Court Order Book 7 (Oct 1881 – Dec 1882)

It appearing that Wm. Peyton Early, minor over age 14, has no guardian (his parents being dead), and at the request of said minor, R.B. Darr is appointed his guardian.  Surety: S. Hodge.  [OB 7, p. 47,  2 Jan 1882]

It appearing that James Matthews, guardian for the Franklin heirs has received nothing for the heirs, therefore Matthews is permitted to resign as guardian.  [OB 7, p. 63,  13 Feb 1882]

L.C. Frazier was appointed guardian for his infant children, Julia Ann & Edward C. Frazier, both under the age of 14.  Surety: W.H. Koon.  [OB 7, p. 67,  14 Feb 1882]

Webster County, Kentucky Guardian Appointments 1861 - 1862

 

A guardian was appointed when a person was unable to act for himself or was a minor (under the age of 21 years). At the age of 14, a minor could choose his own guardian. If under the age of 14, the county court appointed the guardian. To guarantee the faithful performance of his duties, another person was required to sign as security or surety on the guardians’ bond. In Webster County, guardian appointments are recorded in the county court order books and the guardian bond books.  The following records were abstracted from County Court Order Book 1 (1860 – 1866).  Differences in information in Guardian Bond Book 1 (1860 – 1870) are noted in footnotes.

Livingston County, Kentucky Guardian Appointments 1854

A guardian was appointed for a person who could not act for himself or was under the age of 21 years. If over the age of 14, the minor could choose his own guardian with the approval of the county court. If under age 14, the county court appointed the guardian. The appointment of guardians was recorded in county court order books (court minutes) as well as in a separate guardian bond book. The following entries can be found in County Court Order Book L as well as in Guardian Bond Book 1853-1863, but the name of the parent of the minor is not always given in the Guardian Bond Book..  The source for each appointment is found at the end of each entry. Crittenden County, Kentucky Guardian Appointments 1874

 A guardian was appointed when a person was unable to act for himself or was a minor (under the age of 21 years). At the age of 14, a minor could choose his own guardian with the approval of the county court. If under the age of 14, the county court appointed the guardian. To guarantee the faithful performance of the guardian, a surety was required to sign the bond, also. The surety acted as guarantee that the guardian would perform his duties. The names of the sureties may be important as often a relative of the guardian or the minor was surety for the guardian.  A guardian was appointed when a person was unable to act for himself or was a minor (under the age of 21 years). At the age of 14, a minor could choose his own guardian with the approval of the county court. If under the age of 14, the county court appointed the guardian. To guarantee the faithful performance of the guardian, a security was required to sign the bond, also. In 1848 Union County, the appointment of a guardian was recorded in  Guardian Bond Book 1848 - 1853 as well as in the County Court Orders Vol. E, 1845 - 1855. Caldwell County, Kentucky Guardian Appointments 1826

A guardian was appointed when a person was unable to act for himself or was a minor (under the age of 21 years). At the age of 14, a minor could choose his own guardian with the approval of the county court. If under the age of 14, the county court appointed the guardian. To guarantee the faithful performance of the guardian, a security was required to sign the bond, also. The following records were transcribed from Court Order Book D (1822-1829), located in the Caldwell County Clerk's Office, Princeton, Kentucky.  The page number on which the information appears in  Court Order Book D is given at the end of each entry.

Crittenden County Guardian Bonds 1867

The intention of the law regarding guardians was to protect the rights of children who were orphans or not old enough to care for their own business. If an underage child inherited property, a guardian was usually appointed to protect his interests. A guardian might also be appointed to represent the child in a law suit (guardian ad litem). At the age of 14 years, a child was allowed to choose his own guardian, but with the county court’s approval. If under age 14, the county court had the responsibility of appointing the guardian for the child. To guarantee the faithful performance of his duties, the guardian and his surety signed a bond. The following entries have been abstracted from Guardian Bond Book 1853-1871 as well as County Court Order Book 3 (1861-1868), Crittenden County Clerk’s Office, Marion, Kentucky. The letter and numbers at the end of the entries refers to the County Court Order Book and page number. For example, 3/349 refers to Order Book 3, page 349.
